Terms of Service
What we will best endeavour to provide to the User:
Our commitment: We will commit to having our hosting equipment online as much as possible. There will be circumstances beyond our control at times and we will work to best avoid these situations where at all possible. We will provide the necessary hosting tools for you to have your web site online.
Your rights to Compensation from us: Where a service we provide to you is affected because we do not meet our responsibilities, we will refund any fee you may have paid to us for the effected period. For us to consider this claim we must be informed within 14 days of the service being affected.
What we ask and expect of the User:
The hosted web site and ensuing web traffic shall not break or infringe any New Zealand or International law. This includes, but is not limited to: copyrighted material, and/or material we judge to be threatening or obscene, or material protected by trade secret and other statute, and invasion of privacy. Should any such activity be detected, Hornby Online will immediately liaise with appropriate government agencies and carry out such actions as directed, including, but not limited to, immediate suspension of the users account.
Commercial Advertising - Email: Spamming, or the sending of unsolicited email, from a Hornby Online hosting server or using an email address or domain that is maintained on a Hornby Online server as reference; is STRICTLY prohibited. Hornby Online will be the sole arbiter as to what constitutes a violation of this provision.
Suspension: Activity which results in a suspension or deactivation of an account will result in a forfeiture of fees paid. Complaints made regarding abuses of an account will be grounds for suspension. Refusal of Service: We reserve the right to refuse, cancel, or suspend service at our sole discretion. Please direct any reports of violations of the above policies to (refer to the Contact Us FAQ) Failure to follow any term or condition will be grounds for immediate account deactivation/suspension).
Charges: Any fees for services will be paid in advance for up to either six or twelve month periods. Shorter intervals may be negotiated for special circumstances at the discretion of Hornby Online.
Non payment of our charges: All accounts must be paid within 7 days of the billing date. Hornby Online reserves the right to suspend the use of our servers as outlined below. The user will remain liable for any solicitor and/or debt collection agent charges incurred in the collection of any money owed.
- 7 days past due- Control panel disabled & notification sent.
- 14 days past due- E-mail services disabled & notification sent.
- 21 days past due - Hosting service completely disabled & notification sent
- 28 days past due – handed to Solicitor/Debt collection agency.
Donations: Community groups using our free services may wish to support our ongoing work. These donations will be gratefully received.
